1. Engagement & Services
ScaleForgeHQ ("Agency", "we", "us"), operated by Dhiraj Roy, provides software development, Spring Boot + React SaaS MVP builds, custom REST APIs, and n8n workflow automations. By engaging our services or placing an order, you ("Client") agree to these Terms of Service.
2. Project Scope & Estimates
All project requirements, deliverables, timelines, and milestones are specified in a formal project scope or written estimate agreed upon prior to project kickoff. Final pricing depends on project scope. Any requests for additional features or revisions outside the agreed scope will be quoted separately.
3. Intellectual Property & Code Ownership
Upon final payment for a custom development engagement, the Client receives full ownership rights and license to the custom codebase, workflows, and documentation created specifically for their project. ScaleForgeHQ retains ownership of pre-existing proprietary frameworks or starter boilerplate kits, granting Client a non-exclusive license to use them.
4. Payment Terms
Engagements operate on milestone-based payments unless agreed otherwise in writing. Payments are non-refundable once milestone deliverables are approved and handed over to the Client.
5. Warranty & Maintenance
We provide post-launch support and bug-fix warranty periods as outlined in your selected tier or contract (typically 7 to 30 days post-handover). Maintenance covers bug fixes related to original specifications but excludes changes caused by third-party API breakages or client modifications.
6. Limitation of Liability & Jurisdiction
In no event shall ScaleForgeHQ or its founder be liable for any indirect, incidental, or consequential damages. These Terms are governed by and construed in accordance with the laws of India. Any legal disputes shall be subject to the exclusive jurisdiction of the courts in India.
